Press statements by Mrs. Ioana Muntean, Spokesperson for the Executive, at the end of the Executive meeting

I would like to make a statement regarding military pensions, to be very well understood. The conclusion that all military pensions will decrease is a fake. The Government's position was and remains unchanged. All military pensions will be recalculated, but this does not mean that all military pensions will decrease. Most of military pensions that are up to 3,000 RON will not be affected by the recalculation of pensions.
Regarding the reduction of up to 69%, this percentage was obtained from a simulation, which was made on a too small number of cases; so we cannot generalize at the level of all military pensions. I got this information from the Ministry of Labour.
With respect to other false information spread on television shows, pertaining to a PM’ statement saying that he would wish to maintain only two secretaries of state in the ministries, I would like to approach the issue in chronological order.
On October 1, 2009, PSD withdrew from the Government. On October 2, Prime Minister made this statement. Prime Minister referred to the fact that there would remain only two state secretaries, but only until a new government is invested, until after elections.
In other words, Prime minister stated he would not bring secretaries of state from PDL to fill vacancies remaining after PSD withdrawal from government.
As you know, the positions of Secretaries of State are political positions. This Executive is backed by political parties and the positions of secretaries of state are divided accordingly.
Another clarification: the Ministry of Economy had four secretaries of state before being merged with the Ministry of SMEs that had three secretaries of state. By merging the two Ministries, there would have to be seven positions of Secretaries of State. Today, there are five posts of Secretaries of State and not six, as some televisions misinformed. Ministry of Economy’s organizational chart will remain unchanged.
The same happened at the Ministry of Finance. There were four posts, yes, and there were only four posts and three secretaries of state. And Mr. Nazare Alexandru came to a vacancy. The organizational chart of the Ministry of Finance was not changed.
In other news I want to inform you that the Executive will meet on Monday morning at 8:00 a.m. to adopt the Draft National Education Law. The draft law will be sent to Parliament and will enter into debate of Standing Bureaus, to enter afterwards in parliamentary procedure since Monday.
Today, the Government approved an emergency ordinance on employment measures in the budgetary sector. Through GEO 34/2009, we set that only 15% of the number of vacancies may be filled by competition at the level of main credit chief accountants.
The ordinance approved today will make employment a priority in those structures of Ministries that deal with attracting and managing European funds. How exactly will this work? The vacancies’ occupation will be made through approval of the Government, after a centralization of these vacancies and then there will be a redistribution of these posts, priority having the structures dealing with management of EU funds.
Centralization will be made at the Ministry of Finance, the 15th of each month for the previous month. And of course, such redistribution and filling of vacancies will be made, complying with that 15% percent.
The vacancy filling may be based on two types of legislative acts: memorandum when vacancies are sent from a main credit chief accountant to other, and the Executive decision when redistributing these vacancies, together with relevant funds between budgets of the main credits’ chief accountants of the state budget.
The purpose of the Emergency Ordinance approved today by the Executive is to solve first, one of the Government's strategic priorities, namely, absorption of European funds.
Today, there was approved the Emergency Ordinance to amend the National Archives Law. The government changed the law so that the National Archives’ archival work only for documents with practical value can be made by companies providing archiving services.
This amendment is necessary to facilitate people's access to documents with practical value and to allow their release in as short time as possible. In this category of documents, most requests from citizens concerns issuing certificates attesting seniority, especially from companies that were terminated or are in liquidation. Currently, the issue of such certificates may take time, sometimes being even impossible, both because of acute shortages of storage facilities and insufficient staff assigned to the National Archives and lack of funds necessary to conduct these activities.
The amendment made today by the Executive, namely the takeover of the archiving activity for documents with practical value by companies working in this field, will be enforced to documents that have not been taken over by any institution, as well as for documents with practical value about to be created in the future.
According to Emergency Ordinance, the creators and holders of documents, thus public or private institutions, or according to case, their successors are compelled to release, on the request of individuals or legal entities, certificates, copies or extracts from documents they create or hold, if they refer to rights pertaining to applicant.
The legislative act adopted by the Government specifies that in case of dissolution of such public or private institutions, without its activity being continued by other, documents with historical value are taken over by the National Archives or the county services of National Archives.
Documents with practical value, based on which, copies, certificates and statements of rights related to social security contribution of the citizens are delivered to authorized economic operators. Currently, there are companies established under the Company Law, so with private capital, unauthorized by the National Archives, that provide archival services. Under this ordinance, they will be authorized. Other companies can be authorized to conduct such an activity.
Authorization for the functioning of economic operators, as providers of archive services, will be made by the National Archives and county services of National Archives.
This operating permit is issued for a fee, if several conditions are fulfilled related to professional competence, material base, existence of a fund to cover the costs of transfer of held documents in the event of termination of business, and the existence of internal regulations of archival practice.
Operating authorization is issued for a period of 3 years and may be renewed for the same period.
Procedures for issuance, renewal, suspension or withdrawal of authorization shall be determined by detailed rules, approved by order of Minister of Interior, to be published in the Official Gazette.

Reporter: If that document from the Ministry of Defense, on military pensions, is not relevant, why government is not so sure that no pension will fall to 3,000 RON?
Mrs. Ioana Muntean: As I said, this is the Government's position. This is how left the draft pension law left the Government, based on these principles under which all military pensions are recalculated, but this does not mean that all will decrease. Most military pensions are up to 3,000 lei and will not be affected by recalculation.
