Press statements by Prime Minister Emil Boc and Minister of Labour, Mr. Mihai Seitan, at the beginning of the Executive meeting
PM Emil Boc:
We propose to start with the draft laws on the daily agenda. Draft law on the ratification of the Convention on the rights of persons with disabilities - a draft law awaited by organizations in the field, and persons with disabilities. We take the decisive steps for the ratification by Parliament of this Convention. Minister Seitan, please.
Minister Mihai Seitan:
Thank you Mr. Prime Minister. It's about the ratification of the Convention on the Rights of Persons with Disabilities, adopted by UN General Assembly in December 2006, and signed by Romania, in September 2007. There is a long time since we signed the Convention and we will have to ratify it. Convention is based on the UN Charter concerning persons with disabilities, and its aim is in particular, to promote, protect and ensure the full exercise under conditions of equality of all human rights and fundamental freedoms by all persons with disabilities and to promote respect for their dignity. As a signatory of the Convention, Romania is committed to ensuring and promoting the full exercise of all human rights and fundamental freedoms for all persons with disabilities without any discrimination based on disability, through appropriate legislative measures, law amendments, human rights promotion, provision to people with disabilities in particular, accessible information on the devices needed to carry out the activity or movement, and mobilizing all available resources to ensure the full enjoyment of economic, social and cultural needs of people with disabilities. Under these conditions, please Mr. Prime Minister and Ministers, let us approve these draft laws. Thank you.
PM Emil Boc: Ministry of Justice? If other Ministries have other observations. We consider the draft law approved and we send it to Parliament for passing and, given the long duration from signing until adoption, I would propose the emergency procedure for the entry into force of the Convention. The draft law for the ratification of the Agreement in the social security field between Romania and Canada. Minister Seitan, please.
Minister Mihai Seitan:
Thank you, Mr. Prime Minister. In November 2009, the social security agreement was signed in Ottawa, between Romania and Canada, agreement proposed for ratification by this draft law. It is a bilateral legal framework between Romania and Canada in the social security field, aiming primarily at the recognition and totalizing social insurance periods completed on the territory of both countries, setting up of cooperation between national authorities and institutions responsible for granting social benefits, and setting procedures for making payments. In this context, it provides equal treatment of all persons, with our citizens or Canadian citizens, and the possibility to export social security benefits regulated by the Agreement. So far, a person taking a pension in Romania could not receive his pension in Canada or vice versa. For providing benefits, there is aggregation of insurance periods completed under the legislation of both countries. In other words, we adapt to the relationship with Canada, the situation that occurs in the EU, equal treatment and pro-rata temporis system for calculating pensions, specifically. For this reason, and that there is a sufficiently large number of Romanians in Canada and even Canadians who have settled in Romania, we request you to approve this draft law.
PM Emil Boc:
Thank you. If Ministries have comments. The draft law has got all sanctions. We consider the draft legislative act approved. Draft law for the amendment of Article 36 to Law 160/98 on the organization and exercise of veterinary profession. It was draft ordinance; I turned it into draft law, for it's about compatibility with European Directive regarding fees for the free medical and veterinary practice. The current wording of the law says that these fees are determined on competence criteria, the Veterinary College setting mandatory minimum fees. European legislation requires them to be determined by each veterinarian, without involving the Veterinary College.
Madam Andreescu, this is the only change, if I understood well.
Mrs. Daniela Andreescu, Secretary General of the Government: It is the only amendment to Article 36.
PM Emil Boc:
For compatibility with the European directive.
Mrs. Daniela Andreescu: Only with respect to compatibility of internal legislation with EU law. There are exactly the changes you took into account.
PM Emil Boc:
Article no. 15 of the European Parliament and Council Directive 2006/123. Our request to Parliament is to enforce the emergency procedure, since it is about the transposition of European directive so that within 45 days at maximum, it is passed by both Houses of Parliament, for this provision to take effect. Are there other comments from colleagues? No. We consider the draft law approved and we sent it to be passed in emergency procedure.
