The beneficiaries of the Sapard loans will guarantee the co-financing with the actives buy through financed projects

The beneficiaries of the Sapard loans, within some measures accredited by the European Commission, can guarantee the credits taken from the banks for the co-financing of the loans with the actives buy through financed projects. This is establishes through an Emergency Ordinance adopted by the Government on August 11, 2005.

The Ordinance concerning the acceleration of the SAPARD funds' absorption through the guaranty of the co-financing credits with the actives buy within the SAPARD projects directs to the following measures accredited by the European Commission:

- The measure 1.1 "The improvement of the marketing and processing of the agricultural and piscicultural products";

- The measure 3.1 "The investments in the agricultural exploitations";

- The measure 3.4 "The development and the diversification of the economic activities for the generation of multiple activities and alternative revenues";

- The measure 3.5 "The silviculture"

The Government has decided to grant guarantee facilitations for the beneficiaries of the SAPARD projects toward to accelerate the absorption of the funds allocated through this project.

In the case in which, the beneficiaries do not carry out the reimbursement obligations of the credits, these will be paid firstly from the budget of the Ministry of Public Finance, position "Transfers afferent to the National Pre-accession Fund". These will be afterward transferred to the SAPARD Agency in the sight to pay the payment obligations, according to the contracts complete for the fulfilment of the measures included in the SAPARD Program.

In the case in which the beneficiaries of the SAPARD projects do not fulfil afterwards the conditions stipulated in the Multi-annual Financing Agreement, the Ministry of Public Finance has the right to declare terms and to obtain the immediate payment of all the sums owed and non-repaid, inclusively the accessories. The recuperation from the beneficiaries of the sums resulted from these debts is made according to the procedure regulated by the legislation in force.
