The Executive has deferred the payment of salary rights stipulated by court rulings

The Government has adopted today an emergency ordinance on the payment of some amounts provided in executory titles intended to confer salary rights to the budget sector personnel, decision taken as a result of budget constraints imposed by the current economic situation, " Mrs. Ioana Muntean, Spokesperson for the Government stated.
According to this legislative act, the payment of the amounts provided by judicial decisions, enforceable until the effective date of this emergency ordinance, shall be done as follows: 34% of the value of the executory title- in 2012, and 33% of the executory title- in 2013, 2014 respectively.

By this decision, the Government has deferred the payment of the amounts provided by court rulings regarding the granting of some salary rights established for state personnel. According to GEO 71/2009, these rights won in court were to be paid in installments as of 2010, for decisions enforceable by the end of 2009, and as of 2011 – for those enforceable until the end of this year.
The legislative act pertains to public authorities and institutions whose funding is ensured as follows:
 entirely from the state budget, local budgets, state social security budget, the budgets of special funds, as appropriate;
 own revenues and subsidies from the state budget, local budgets, social security budget, special funds budgets, as appropriate;
entirely from own revenues.
The amount of sums resulted from executory titles intended for salary rights formulated by state sector personnel is 2.163 million lei, representing 0.4% of GDP.
"In these circumstances, the Government's decision on the phasing of the payment of such remuneration won in court aims to maintain the budgetary balance, and thus observe domestic and international commitments undertaken by the Government," the Spokesperson for the Executive has stated.
