The National House of Pensions and Other Social Insurance Rights (CNPAS) will elaborate the records- of the rights and obligations of insured and pensioners and will make the payment of money rights or other benefits deriving from the insured or pensioner quality, on the basis of the personal identity code, as well as of the insured civil status data, an Emergency Ordinance adopted yesterday stipulated. According to the legislation in force, these records - are made only on the basis of the personal number code
The Interior and Administrative Reform Ministry will provide for free to the National House of Pensions and Other Social Insurance Rights (CNPAS) the updated civil status data for all Romanian citizens, EU citizens, and of the member states of the European Economic Space and the foreigners with registered residence in Romania as well as of the persons for which CNPAS drafts payment documentation and makes the payment for some social services.
MIRA will provide these data through the National Centre of People Data Bases Administration or, according to case, for the Romanian Office for Immigrations.
According to Law 41/ 2004, the money rights, other benefits deriving from the insured or retired quality, as well as the payment obligations are paid, according to case, are communicated at home. Some services are provided by the tutors, since to a great extent, the titular are minors for whom there are no identification data in the data base of the system.
Whereby the amendments made to Law 41/ 2004, through the ordinance adopted yesterday, there is removed the risk of unjustified payments to other persons than the titular of the rights and the situations of payment impossibility as well as the impossibility of drafting of rights and obligations are avoided.
At the same time, the measure aims at avoiding any risks which may prompt the decrease in the trust of participants to the privately managed pensions' funds, in the context of the process of transfer of contributions to the privately administered pension's funds, important stage in the implementation of the new system of pensions.
According to the Emergency Ordinance, the content, ways and deadlines of information conveyance on the insured civil status data are established whereby protocols concluded between CNPAS and The National Centre in charge of the administration of persons recording data bases as well as between CNPAS and the Romanian Office for Immigration.
MIRA will provide these data through the National Centre of People Data Bases Administration or, according to case, for the Romanian Office for Immigrations.
