PM Victor Ponta sent a letter to CSM (Superior Council of Magistracy) in his capacity as Minister of Justice

Dear Madam,

In view of the fact that on April 3, 2013, the interim term of office of Mr. Daniel Morar expires and the law does not provide for its extension by CSM (Superior Council of Magistracy), which may confer an unlawful character to documents issued from that time onwards by the Public Ministry,
Based on Article 54, paragraph 1 of Law 303/ 2004 stipulating that the Prosecutor General of the Prosecutor’s Office attached to the High Court of Cassation and Justice, the first deputy and his deputy, the Chief Prosecutor of the National Anticorruption Directorate and their deputies, the prosecutors- Heads of Departments of these Prosecutor’s Offices, as well as the Chief Prosecutor of the Directorate for the Investigation of Organized Crime and Terrorist Offences and their deputies are appointed by the President of Romania, at the proposal of the Justice Minister, with the CSM sanction, from amid the prosecutors with a minimum 10 year length of service in the office of judge or prosecutor,
Based on the strictly limited term I assumed with a view to resolving the instable situation of the Public Ministry, identifying solutions to secure its stability and predictability and the observance of Romania’s external commitments, as well as to strengthening the independence of Justice,

I submit to your sanction the following nominations:

-Mr. Tiberiu Nitu, nominated for the Prosecutor General of the Prosecutor’s Office attached to the High Court of Cassation and Justice;
- Mr. Dimitrie Bogdan Licu, nominated for the First Deputy Prosecutor General of the Prosecutor’s Office attached to the High Court of Cassation and Justice;
- Mr. Codrut Olaru, nominated for Deputy Prosecutor General of the Prosecutor’s Office attached to the High Court of Cassation and Justice;
- Mrs. Laura Codruta Kovesi, nominated for Chief Prosecutor of the National Anticorruption Directorate;
- Mrs. Alina – Mihaela Bica, nominated for Chief Prosecutor of the Directorate for the Investigation of Organized Crime and Terrorist Offences;
- Mrs. Elena Giorgiana Hosu, nominated for Deputy Chief Prosecutor of the Directorate for the Investigation of Organized Crime and Terrorist Offences;

Taking note of the position expressed on the informal talks, by members of the CSM Prosecutors Department, I kindly request you to give your sanction to the aforementioned nominations, in accordance with the powers conferred to each institution on the basis of Constitutional and legal provisions.
